“انصاف؛ جانے کس دہلیز پہ
کچھ عرصہ پہلے ایک زیر سماعت کیس کے سلسلے میں ایک سیاسی رہنما کا بیان نظر سے گزرا، اور وہ بیان یہ تھا :
“عدالت نے فیصلہ انسانی بنیادوں پر کیا”-
اور میں سوچ میں پڑ گیا کہ یہ بنیادیں آخر ہیں کیا اور ہماری عدلیہ کی نظر میں انسان کہلانے کا میعار کیا ہے؟
راولپنڈی کی عدالتوں میں اس وقت لگ بھگ 27,000 فیملی کیسز التوا کا شکار ہیں جن کا ابتک کا دورانیہ 2 سے 5 سال کے درمیان ہے۔ ان میں سے اکثریت ان کیسز کی ہے جن میں بعد از علیحدگی یا طلاق، باپ اپنے بچوں سے ملنے کے لیے کوشاں ہیں۔ ایک عرصہ گزر جانے کے باوجود ملاقات کا ایک باقاعدہ شیڈول حاصل کرنے میں ناکامی رہتی ہے اور جس فریق کے پاس بچے ہوتے ہیں، زیادہ تر کیسز میں، وہ عدالت کے جاری کردہ شیڈول کو بالائی عدالت میں چیلنج کر دیتے ہیں اور اپیل کا فیصلہ ہونے تک non-custodial parent مجبور ہوتا ہے کہ وہ احاطہ عدالت میں ہی کچھ دیر کے لیے پچوں سے مل لے۔ اور یہ انتظام دوسرے شہروں سے آئے ہوئے سائلین کے لیے خاص طور پر بہت تکلیف دہ ہو تا ہے۔
اکثر دوسرےشہروں سے آئے ہوئے سائلین کو عدالت پہنچ کر یہ “خوشخبری” ملتی ہے کہ جج صاحب/صاحبہ چھٹی پہ ہیں۔ اور پھر اگلی تاریخ لینے اور پھر سے سارا کشت کاٹنے کے علاوہ کوئی چارہ نہیں ہوتا۔ اکثر ایسا بھی دیکھنے میں آیا ہے (اور یہ زاتی مشاہدہ ہے) کہ کمرہ عدالت سائلین سے بھرا ہوا ہے اور محترم جج میلاد میں شرکت کیلئے تشریف لے گئے ہیں۔ اگر کوئی سائل غصے کا یا مایوسی کا اظہار کرے تو عدالت کے کارندوں کی طرف سے “مذہبی” جذبات کا لبادہ اوڑھ کر اسکی اچھی خاصی بے عزتی کر دی جاتی ہے۔ جو منصف اپنے فرائض کی ادائیگی کے لیے مخصوص وقت کے ساتھ انصاف نہیں کر سکتا، اس نے لوگوں کے ساتھ خاک انصاف کرنا ہے۔ اور ایک طرف ہم دیکھتے ہیں کہ کچھ خاص “انسانی” بنیادوں کے لیے چھٹی والے دن بھی یہ “بازار حسن” سجا لیا جاتا ہے۔ وہ بنیادیں مظبوط غالباً اس وجہ سے ہیں کہ ان میں بھرنے کے لئے مادی وسائل بے پناہ ہیں۔ ورنہ آپ خود سوچیں نہ کہ اس نظام سے محض انصاف کی (احمقانہ)امید سے آپ کسی کا “پیٹ” تھوڑی بھر سکتے ہیں۔
مزید ستم یہ ہے کہ ایک باپ اگر چاہے کہ بچوں کو احاطہ عدالت کے فضول ماحول کی بجائے کہیں باہر لے جا کر مل لے تو اسکو 5 لاکھ سے 15 لاکھ تک کی surety جمع کروانے کا حکم ہوتا ہے، اس “خوف” کی بنیاد پہ کہ باپ اپنے ہی بچوں کو “اغوا” نہ کر لے۔ اور دوسری طرف ہم دیکھتے ہیں کہ ملک کو اربوں روپے کا نقصان کرنے والے کو “انسانی بنیادوں” پر، محض کاغذ کے ایک ٹکڑے پر لکھے چند رسمی الفاظ اور اس انسان کی گارنٹی پر جو کہ خود فی الوقت ملزم تھا، ملک سے باہر جانے کی اجازت دے دی جاتی ہے۔ اور یہاں ایک باپ اپنے ہی بچوں سے اپنی محبت کا اور انہیں نقصان نہ پہنچانے کا یقین دلاتے دلاتے ادھ موا ہوا جاتا ہے۔ واہ رے انسانی بنیادیں صدقے تمہارے۔
الفاظ گرچہ بہت تلخ ہیں لیکن اس وقت عدلیہ کی جو صورتحال ہےاور اس بدبو دار نظام کی وجہ سے جذبات کو اور عزت نفس کو جو ٹھیس پہنچی ہوئی ہے، میں یہاں منٹو کا حوالہ ضرور دینا چاہوں گا
“کہتے ہیں قانون غریب کا رکھوالا ہے۔ سب جھوٹ کہتے ہیں۔ یہ قانون غریب کا رکھوالا نہیں بلکہ کوٹھے پہ بیٹھی وہ رنڈی ہے جو امیر کو تو میسر ہے لیکن بغیر پیسے والے کی طرف دیکھنا تو دور، الٹا اس پہ تھوکتی ہے”
